Nick Scali Limited (Australian Company Number 000 403 896), Plush-Think Sofas Pty Limited (Australian Company Number 080 012 595) and Nick Scali (New Zealand) Limited (NZ Company Number 6267728) (“together referred to as Nick Scali”, “we”, “us” or “our”) respect your privacy and are committed to protecting your personal information.
When you interact with us, you may share “personal information” with us which allows identification of you as an individual (e.g. name, email address, address, and telephone number).
We collect, hold, use, disclose and handle your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the New Zealand Privacy Act 2020 (each a “Privacy Act”).
Australian Privacy Principle 5 (APP5) requires Nick Scali to take reasonable steps to ensure that it notifies an individual of certain matters at the time it collects their personal information.
The purpose of this privacy notice is to let those individuals making employment applications to the Nick Scali know what information is being collected from them, as well as how that information will be used.

What personal information is collected?
- Nick Scali does not collect or solicit any personal information which might be unlawful, unnecessary, excessive or unrelated to its functions or activities.
- Personal information collected by Nick Scali may include:
- name, gender, and date of birth;
- your contact information, including postal and residential addresses, telephone and facsimile numbers, and email addresses;
- your education;
- your employment history;
- academic records, transcripts, enrolment and assessment details; and
- passport and visa details.
- Your personal information that Nick Scali may collect includes a includes a sub-category of information known as "sensitive information". Sensitive information/special category information may include information in respect of:
- health, genetics and biometrics;
- racial or ethnic origin;
- political opinions;
- membership of a political association;
- religious beliefs or affiliations;
- philosophical beliefs;
- membership of a professional or trade association;
- membership of a trade union;
- sexual orientation or practices;
- criminal record.
- For the purposes of the APPs, Nick Scali may collect sensitive information/special category data where that sensitive information/special category data:
- is necessary for Nick Scali to perform a relevant function or activity; or
- must be collected in order to comply with Nick Scali's obligations under law.
How is personal information collected?
- Nick Scali does not collect or solicit any personal information which might be unlawful, unnecessary, excessive or unrelated to its functions or activities.
- Nick Scali will only collect your personal information by lawful and fair means.
- you consent to the collection of the information from someone else; or
- Nick Scali is required or authorised by law to collect the personal information from a third party; or
- n is unreasonable or impracticable to obtain the personal information from you directly.
- Nick Scali collects your personal infonmation when you submit information to the Nick Scali via an online application.
Why does Nick Scali collect your personal information?
- Nick Scali collects your personal information for the purpose of performing our activities or functions (or other reasonably related purposes or as required by law). This includes:
- to collate your contact details;
- to facilitate communication and engagement between you and Nick Scali as part of our recruitment processes;
- to facilitate future employment opportunities with Nick Scali in the event your initial employment application is unsuccessful;
- to operate and maintain its information technology systems;
- to enable third party organisations to provide us with technical and support services;
What will happen if Nick Scali does not collect your personal information?
- You may elect not to provide Nick Scali with your personal information. However, if you choose to do so, Nick Scali may be restricted (if not rendered completely incapable) in its capacity:
- to consider you for employment with Nick Scali
- to employ you at Nick Scali
To whom will Nick Scali disclose your personal information?
- If Nick Scali collected your personal information for a particular purpose (the primary purpose), Nick Scali will not use or disclose this information for another purpose (the secondary purpose), unless:
- you consented to the use or disclosure of the information; or
- you would reasonably expect Nick Scali to use or disclose the information for the secondary purpose.
- Nick Scali will take reasonable steps to ensure that personal information is not disclosed to a third-party, except in certain permitted situations. These include:
- where Nick Scali obtains the individual's consent;
- where it is necessary to provide that information to a third-party who provides services to Nick Scali;
- where the disclosure is required or authorised by law or regulatory obligations; or
- any other circumstance permitted by the APP.

Storage and Security of Information
- Nick Scali will generally hold your personal information as both physical records, records on our servers, and in some cases, records on third party servers, which may be located overseas
- The types of security measures we take vary with the type and nature of the information. These security measures include:
- Restricting access to personal information to limited employees, agents and contractors on a need-to-know basis (e.g. by setting up physical access control systems to Nick Scali premises, requiring passwords to access the database, and building firewalls to prevent the hacking of our database);
- Obtaining a confidentiality undertaking from staff (e.g. by including the relevant clauses in employment agreements with staff);
- Regular training for our staff on the importance of data security and privacy; and
- Using security bins for the disposal of written information.
- your personal data is accessible only to registered employees and contractors of the employer via password protected logins
- Generally, personal information retained by Nick Scali will be stored for as long as Nick Scali requires it to carry out the purpose for which the data was collected, following which time it will be either destroyed or anonymised.
Access and correction of your personal information
- You may request access to your personal information at any time by sending a written request to the Privacy Officer at privacy@nickscali.com.au.
- In the event that Nick Scali is satisfied that the personal information it holds is inaccurate, out-of-date, incomplete, irrelevant or misleading, it will take all reasonable steps to correct that information to ensure that it is accurate, up-to-date, complete, relevant and not misleading.
- Nick Scali will generally grant an individual access to their personal information unless an exception applies. Exceptions include where:
- giving access would have an unreasonable impact on the privacy of other individuals;
- the request for access is frivolous or vexatious;
- the information requested does not exist or, despite reasonable efforts to locate it, cannot be found;
- the request is manifestly unfounded or excessive (taking into account whether the request is repetitive in nature);
- the access would be unlawful; or
- where we are otherwise permitted by a relevant Privacy Act to do so.
- You may request correction of any inaccurate personal information that we have about you, and you may ask us to delete your personal information that we collect or maintain about you.
- If a request for access, deletion or correction is denied by Nick Scali it will, within a reasonable time period, provide the individual who made the request with a general, written explanation as to why the request was refused.
Status of your consent
- If you have provided your consent to the collection, use and disclosure of your personal information in accordance with the Privacy Policy, you have the right to withdraw that consent at any time by contacting the Privacy Officer at privacy@nickscali.com.au
- The withdrawal of your consent does not affect the lawfulness of the manner in which your personal information was handled/processed before your consent was withdrawn.
